Procter & Gamble Says Mouthwash Product Kills Germs and Creates the Appearance of Brown Stains on Teeth?

This sounds like a terrible product: Crest Pro-Health mouthwash. Also, one would think that P&G's spokesperson would be better off not promoting the mouthwash's brown-staining effect on teeth. It's something to consider in the future when, naturally, another product of theirs doesn't deliver on its label's promise.

From the Associated Press:

DETROIT — A lawyer seeking fresh breath says he got brown stains instead.

Mark Rossman of suburban Detroit is suing Procter & Gamble Co., saying his teeth have stains on the edges after he used Crest Pro-Health mouthwash.

"My wife asked me, 'What's on your teeth?'" he said Thursday after his partners in Troy filed a lawsuit in federal court in Detroit. "I flossed, brushed — it wouldn't come off.

"I didn't even think of the mouthwash until I did some Internet research and saw complaints," Rossman, 34, said.

A P&G spokeswoman, Laura Brinker, declined to comment on the lawsuit but said "99.9 percent" of users have not complained.

"We stand behind our product," she said. "Tooth discoloration is a very complex matter and is influenced by many different things."

AP: Matrixx Stocks Fall After Zicam Lawsuits Announced

From the Associated Press:

NEW YORK (AP) — Shares of Matrixx Initiatives Inc. fell Monday after the company disclosed several class action lawsuits related to its withdrawn cold treatment Zicam.

After the markets closed on Thursday ahead of the long holiday weekend, the Scottsdale, Ariz.-based company said it is aware of six class action lawsuits connected to Zicam. The company also has disclosed a personal injury lawsuit involving 117 plaintiffs.

The Food and Drug Administration advised consumers to stop using Zicam products in mid-June, because the zinc in Zicam swabs and gel may damage the sense of smell. Matrixx started a voluntary recall on June 24.

"The company intends to vigorously defend each of the recently filed lawsuits," Matrixx said in a filing with the Securities and Exchange Commission. It said it expects more lawsuits.

Matrixx disclosed lawsuits involving residents of Arizona, Illinois, California, Florida, Texas, Minnesota, Wisconsin and Missouri. It said the California suit "alleges, among other things, that the company concealed or omitted material information regarding the safety of the nasal gel products."

In afternoon trading, Matrixx shares fell 73 cents, or 11.3 percent, to $5.75. The stock has ranged from $4.39 to $19.74 over the past year.
Originally posted at InjuryBoard by Paul Kiesel

AP: Former Priest Claims Molestation by Childhood Priest

From The Associated Press:

ORANGE, Calif. (AP) — A former Roman Catholic priest filed a lawsuit Monday claiming that as a teenager in Southern California he was abused by a priest who was his mentor.

Ben Rodriguez, who left the priesthood in 2006, claims that Gordon J. Pillon molested him multiple times from 1978 to 1981 at Our Lady of Guadalupe Church in La Habra.

The lawsuit said Pillon eventually influenced Rodriguez to enter seminary and become a priest.

Rodriguez's attorney Joseph George said Pillon is a professor at the University of Northern Virginia's campus in Prague. An e-mail to a Gordon Pillon at the Prague campus was not immediately returned.

In 2006, the diocese in Peoria, Ill., said Pillon was asked to step down after allegations of sexual misconduct with a minor surfaced. The Peoria diocese, where Pillon had been serving since 1993, said the alleged abuse happened when Pillon was serving in Orange County.
Originally posted at InjuryBoard by Paul Kiesel

Bankrupt: Peanut Corp. to Liquidate All Assets

From the Associated Press:

ATLANTA (AP) — The peanut processing company at the heart of a national salmonella outbreak is going out of business. The Lynchburg, Va.-based Peanut Corp. of America filed for Chapter 7 bankruptcy in U.S. Bankruptcy Court in Virginia Friday, the latest bad news for the company that has been accused of producing tainted peanut products that may have reached everyone from poor school children to disaster victims.

"It's regrettable, but it's inevitable with the events of last month," said Andrew S. Goldstein, a bankruptcy lawyer in Roanoke, Va., who filed the petition.

The salmonella outbreak was traced to the company's plant in Blakely, Ga., where inspectors found roaches, mold and a leaking roof. A second plant in Plainview, Texas was shuttered this week after preliminary tests came back positive for possible salmonella contamination. So far, the outbreak has been suspected of sickening more than 630 people and may have caused nine deaths. It also has led to more than 2,000 product recalls, one of the largest recalls in U.S. history.

Companies file Chapter 7 to liquidate their assets and distribute the proceeds to creditors. A trustee is automatically appointed to oversee the wind down, as opposed to a Chapter 11 filing that gives a company breathing room while it tries to reduce its debts and continue in business. The company said in the filing that its debt and assets both ranged between $1 million and $10 million.

The board had considered a Chapter 11 bankruptcy but decided on an outright liquidation. It said in a court filing that the recalls had been "extremely devastating" to the company's financial condition.

"We kicked the tires on trying to reorganize, but the fact of the matter is they've absolutely closed down," Goldstein said. "They're prevented from carrying on business. There didn't seem like there would be any prospects."

The company's problems have multiplied since the link to its Georgia plant.

Article continues here.
Originally posted at InjuryBoard by Paul Kiesel

Ticketmaster Trying to Double Its Profits Through "Monopolistic Scheme"

Bloomberg News, the Associated Press and other media outlets quickly picked up this news story, even with all of the Economic Stimulus news that's absorbed most websites and newspapers' headlines: Ticketmaster has been illegally conspiring to monopolize the resale market for sports, concert, and show tickets.

According to the complaint filed by Mr. Paul Kiesel, "Ticketmaster profits twice as the result of the monopolistic scheme [and] defendants have illegally bilked event ticket purchasers out of millions of dollars."

The plaintiff named in the lawsuit used an alternate site to purchase tickets to a Bruce Springsteen concert -- incidentally owned by Ticketmaster (and a site that gives Ticketmaster 15% of its profits) -- a site that consistently marks ticket prices up hundreds and even thousands of dollars.

Story continues below from Bloomberg News and The Boston Globe:

TORONTO - Ticketmaster Entertainment Inc., the biggest ticketing company in the world, is illegally conspiring to monopolize the resale market for sports, concert, and show tickets, lawyers claimed in a suit filed after singer Bruce Springsteen complained about the company's sales practices.

Ticketmaster was sued for redirecting fans, including those trying to buy Springsteen tickets Feb. 2, to TicketsNow.com where the tickets were marked up by hundreds and even thousands of dollars. Ticketmaster gets a 15 percent cut from TicketsNow, which it owns, Paul Kiesel, lawyer for the plaintiff, said in the complaint filed Friday in Los Angeles federal court.

"Ticketmaster profits twice as the result of the monopolistic scheme," Kiesel, of Kiesel, Boucher & Larson LLP, said in the complaint, which seeks unspecified monetary damages and an injunction to stop the practice. "Defendants have illegally bilked event ticket purchasers out of millions of dollars."

Fan complaints that they were steered to TicketsNow when they tried to buy Springsteen tickets prompted a New Jersey congressman to call for a federal antitrust investigation into Ticketmaster's sales practices. Attorneys general in that state and in Connecticut are looking into the matter.

Springsteen, in a posting on his website, condemned the sales practice. "We perceive this as a pure conflict of interest," Springsteen said. "The abuse of our fans and our trust by Ticketmaster has made us as furious as it has made many of you."

Ticketmaster, of West Hollywood, Calif., issued an apology Feb. 4 for having steered Springsteen fans to TicketsNow and vowed to refund them the price difference between the face value of tickets and those purchased through the reseller.
Originally posted at InjuryBoard by Paul Kiesel

GMAC Spends $410,000 Lobbying on Bills Related to Mortgage Lending

According to Forbes.com and the Associated Press, GMAC LLC spent $410,000 in the first quarter lobbying on several bills related to mortgage lending and other issues, according to a disclosure report (Forbes.com, 6/13/08).

The bills that GMAC lobbied on would raise the limits on government-insured mortgages and allow judges to alter mortgage loans for homeowners in bankruptcy. Both issues have been a top priority for consumer groups of mortgagees.

The bankruptcy legislation is pending in Congress and it is not certain if it will pass through with enough votes to circumvent a veto by President Bush.

GMAC also lobbied on legislation involving financial literacy, reforms of government-sponsored mortgage giants Fannie Mae and Freddie Mac, the use of consumer credit reports, and the taxation of liability corporations.

Overall, this is great news to see GMAC take the initiative to help start cleaning up the mortgage industry and its lending practices. It'll be interesting to see if the bill relating to mortgage reform in BK courts passes through Congress, but, nonetheless, this is a positive step and encourages other corporate entities to participate in mortgagee relief.
Originally posted at InjuryBoard by Paul Kiesel
